Welcome to M and W Guns. By accessing or using our website, services, or making a purchase, you agree to be bound by these Terms of Use. Please read them carefully.


1. Eligibility

  • You must be at least 18 years of age to browse and purchase long guns and related products.
  • You must be at least 21 years of age to purchase handguns.
  • By using our website, you certify that you are legally eligible to own and purchase firearms under federal, state, and local laws.


2. Firearm Sales & Background Checks

  • All firearm sales require a completed background check in compliance with federal law.
  • No firearm will be transferred to any customer until the background check has been approved.
  • By placing an order, you understand this is a request to purchase, not a completed sale. Final payment and transfer occur only after approval.
  • Firearms must be picked up in person or shipped to a licensed FFL (Federal Firearms License) dealer.


3. Deposits & Payments

  • A nonrefundable deposit (e.g., $25.00) may be required to reserve a firearm.
  • The remaining balance will be invoiced and collected after successful background check approval.
  • Accessories, ammunition, and non-firearm items may be purchased and paid for directly through the website.


4. Shipping & Transfers

  • Firearms cannot and will not be shipped directly to a customer’s home.
  • The customer is responsible for selecting an FFL dealer and covering any transfer fees charged by that dealer.
  • Shipping times may vary and depend on the processing times of the receiving FFL dealer.


5. Compliance with Laws

  • It is the customer’s responsibility to be aware of and comply with all applicable firearm laws in their state or locality.
  • Orders that violate federal, state, or local laws will be canceled.


6. Returns & Cancellations

  • Firearm sales are final once the transfer process has been completed.
  • Canceled orders may be subject to restocking or service fees.
  • Accessories and non-firearm items may be eligible for return within 30 days if unused and in original packaging.
  • Ammunition and firearms are nonreturnable for safety reasons.


7. Limitation of Liability

  • M and W Guns is not responsible for misuse, unsafe handling, or unlawful use of any firearm or product purchased.
  • By purchasing, you assume all responsibility for the safe and lawful handling, storage, and use of firearms.


8. Intellectual Property

All website content, including text, images, and logos, are the property of M and W Guns and may not be copied or used without permission.


9. Changes to Terms

We may update these Terms of Use at any time. Updates will be posted on this page with the revised date. Continued use of the website constitutes acceptance of the updated terms.
